Difficulties Repaying a Consumer Credit
If you can no longer repay your credit, ask your lender if they can offer you a payment plan.
If they do not reply or refuse your request within one month after your registered letter, or if their proposal is unsatisfactory, you can turn to your justice of the peace and request payment arrangements.
If you are in arrears or receive payment facilities, you will be registered in the negative section of the Individual Credit Register (ICR). Once your arrears are settled, those records will remain in the Individual Credit Register (ICR) for 12 months.
You always have the option of entering debt mediation or opting for collective debt settlement. Many organisations (such as associations or your municipality's CPAS) can assist you, for example, by negotiating arrangements with your creditors to help you overcome your difficulties. You can find those organisations at the following link:
- for Brussels: Centre d’Appui aux Services de Médiation de Dettes [Support Centre for Debt Mediation Services]
- for Wallonia: Observatoire du Crédit et de l'Endettement[Credit and Debt Observatory]
- for Flanders: Eerste hulp bij schulden [First aid for debt]
