Funds Withdrawn from Your Account Without Your Authorisation. Is the Bank Required to Reimburse in Cases of Phishing?

Was your bank account used without authorisation? Your bank must reimburse you in specific cases.

You are responsible for losses up to 50 euros for unauthorised payment transactions resulting from the use of a lost or stolen payment instrument, or from the unlawful use of a payment instrument, if these transactions were made before you notified your bank. The bank must reimburse you for any losses incurred from payment transactions made after you have notified them.

Additionally, if the fraud (such as the loss, theft, or unauthorised use of your payment instrument) could not have been detected beforehand, the bank must fully refund the lost amount, both before and after your notification.

In case of gross negligence, the bank may refuse to reimburse (e.g. you wrote down your security details in an easily recognisable form on your payment instrument or you did not notify the bank of the loss or theft of your card). The bank is responsible for proving gross negligence.
